Signing the purchase in Spain
We recommend that the buyer comes to Spain once the documentation and notarial appointment are fully prepared.
The signing route we recommend
- Confirm the buyerNationality, tax residence, passport, NIE, source of funds and contact details are reviewed.
- Agree the changesShareholders, director, company name, address, corporate purpose, CNAE and powers are defined before the appointment.
- Prepare the notaryThe file is sent to the selected notary and any interpreter requirement is confirmed.
- Travel and signThe transfer and agreed corporate resolutions are signed during the prepared appointment.
Language requirement. The buyer must understand Spanish or English, or arrange an interpreter accepted by the notary. The notary may require an official interpreter, so this must be confirmed before travel.
Can the purchase be signed by power of attorney?
It may be possible, but it is not our preferred route for an international buyer. A foreign power often requires local notarisation, an apostille or legalisation, translation and prior approval of the wording.
Because this creates more delay and more points of failure, travelling to Spain for one prepared appointment is usually the practical option.
